INTRODUCTION

You agree to use eBariz.com website (the “Website”) only for purposes that are permitted by this Terms & Condition and any applicable law, regulation, or generally accepted practices or guidelines in the relevant jurisdictions.

You agree that you will not engage in any activity that disrupts or otherwise interferes with the Website (or the servers and networks which are connected to the Website). You agree that you will not duplicate, reproduce, copy, sell, trade, or resell the Website for any purpose.

You agree that you are solely responsible for any breach of your obligations under this Terms & Conditions and for the consequences (including any loss or damage which eBariz.com may suffer) of any such breach.

YOUR ACCOUNT AND AMENDMENT TO THE TERMS OF USE

You may be required to register with eBariz.com to certain services or areas of the Site. Concerning any such registration, we may refuse to grant you the user name you request. Your username and password are for your personal use only. If you use the Site, you are responsible for maintaining the confidentiality of your account and password and restricting access to your computer. You agree to accept responsibility for all activities that occur under your account or password. In addition to all other rights available to eBariz including those outlined in these Terms & Conditions, eBariz.com reserves the right, in its sole discretion, to terminate your account, refuse service to you, or cancel orders.

We may modify or change the Terms and Conditions from time to time. The revised Terms of Use will govern your future use of our Site and Service, so we strongly suggest that you periodically visit and review our Terms of Use. Each version is specifically dated. If you do not agree to the revised version, you must immediately stop using our Site and Service. Our Terms of Use were last updated on July-25-2018 Terms and Conditions Agreement applies from this date onwards.

INTELLECTUAL PROPERTY

All content included on the Site, such as text, graphics, logos, images, audio clips, video, data, music, software, and other material (collectively “Content”) is owned or licensed property of eBariz or its suppliers or licensors and is protected by copyright, trademark, patent, or other proprietary rights. The collection, arrangement, and assembly of all content on the Site is the exclusive property of eBarizeBariz and its suppliers and licensors expressly reserve all intellectual property rights in all Content.

LEGAL CAPACITY TO MAKE AGREEMENTS AND TRANSACT

If you are under the age of eighteen (18) years you cannot place orders with eBariz.com. By accepting these Terms of Use you acknowledge that you are over the age of eighteen (18) years. Should eBariz suffer any damage or other losses as a result of a transaction entered into by a minor, eBariz.com reserves the right to seek compensation for such losses from the parents or guardians of the minor who caused any order(s) to be placed with eBariz.

PRICES

  • Base Currency.

All fees and prices are in UAE Dirhams (AED)

  • Changing of Prices.

eBariz prices are subject to modification at any time. Prices may also vary due to a launching price, a promotional offer, or sales. Prices of items that are not in stock or that are available for a pre-order are valid during the promotional period after the order was placed. Should the price of those items change concerning the pre-order price, the Customer will be informed and will have the possibility to cancel the order. We reserve the right to update prices displayed on the website from time to time and once updated, they cannot be claimed against an order that has already been confirmed or delivered.

  • Typographical

eBariz.com strives for accuracy in all item descriptions, photographs, compatibility references, detailed specifications, pricing, links, and any other product-related information contained herein or referenced on our Website. Due to human error and other determinate, we cannot guarantee that all item descriptions, photographs, compatibility references, detailed specifications, pricing, links, and any other product-related information listed is entirely accurate, complete, or current, nor can we assume responsibility for these errors. In the event a product listed on our Web site is labeled with an incorrect price due to some typographical, informational, technical, or other error, eBariz.com shall at its sole discretion have the right to refuse and/or cancel any order for said product and immediately amend, correct and/or remove the inaccurate information.

Additionally, all hyperlinks to other Web sites from eBariz.com are provided as resources to customers looking for additional information and/or professional opinion. eBariz.com does not assume responsibility for the claims and/or representations made on these or any other Web sites.

ORDERS

  • Placing An Order

Placing an order can be done from the website, by telephone eBariz. Should you place an order from the website, you have to be sure that personal data is correct and updated. eBariz suggests the Customer proofread his/her form several times before validating an order. eBariz is neither responsible for sending e-mails to the wrong e-mail address nor for sending parcels to the wrong delivery address if the form is incorrectly filled-out.

  • Processing Time

You can expect your order to be processed within approximately 24-48 hours, provided the items are in stock and there are no problems with payment verification. eBariz.com does not guarantee the same-day – shipping. Orders are not processed on weekends and holidays.

  • Order Acceptance Policy

Your receipt of electronic or other forms of order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. eBariz.com reserves the right at any time after receipt of your order to accept or decline your order for any reason. eBariz.com reserves the right at any time after receipt of your order, without prior notice to you, to supply less than the quantity you ordered of any item. We may require additional verifications or information before accepting any order.

  • Order Acknowledgement

eBariz.com will keep you informed of your order status via e-mail. All tracking information will be emailed to your eBariz.com ID once your order has been processed or changed status. You may also acquire your order status and other live updates by logging in to your account on our Web site.

  • Change Orders

You may request a change to your order provided the order has not already been charged to your account. Please call us during eBariz.com‘s hours of operation to request a change to your order. Please have your sales order (SO) or customer number ready for better assistance. We strongly discourage sending change order requests via email because it is unlikely we will receive the message in time to make an adjustment due to the sheer volume of emails we receive each day.

  • Cancel Orders

You may request that an order be canceled provided the order has not already been processed and shipped. Simply call us during eBariz.com’s hours of operation to request an order cancellation. We strongly discourage sending order cancellation requests via email because it is unlikely we will receive the message in time to void the order due to the sheer volume of emails we receive each day.

PAYMENT

eBariz.com currently offers COD (“Cash on Delivery”) payments. However, Cash On Delivery option is only applicable within the United Arab Emirates. In order to protect the website visitors to the best of our knowledge, we implement several security policies and certificates. These layers of protection could be bypassed if the user’s computer is/was infected with a virus or malicious software. eBariz or its associated partners and employees cannot be held responsible in such a scenario or circumstance.

eBariz reserves the right to refuse a delivery or honor an order from a Customer who has not paid part or the totality of a previous order or with whom a litigious dispute is in progress. eBariz.com also reserves the right to take any necessary steps including legal action in case of outstanding or non-payment of fees by you.

INVOICE

The order form filled out online by the Customer cannot be considered an invoice. Regardless of the purchase or payment methods, the Customer receives an invoice inside his/her parcel when it is delivered. A digital/hard copy of each invoice is registered in eBariz database.

SECURITY

eBariz.com will take all reasonable precautions to ensure the security of any payment details included in your order nevertheless, barring direct negligence on our part, we cannot be held liable for any losses incurred as a result of unauthorized access to the information you may provide. DISPUTES

If any dispute, claim, controversy, or difference (including in relation to any tortious or statutory claim) (“Dispute”) arises out of or in connection with or in relation to this User Agreement, including (without limitation) any question regarding the formation, existence, scope, performance, interpretation, validity or termination of this User Agreement or this clause, or any question regarding the legal relationships established by this User Agreement or the consequences of its nullity, then the parties shall first attempt amicably to settle the dispute through good-faith negotiations over a period of thirty (30) calendar days commencing on the date that a party first sends to the other party written notice of the Dispute.

In the event that a Dispute has not been settled amicably by the relevant parties by the end of such thirty (30) calendar day period, the parties hereby agree that the Dispute shall be referred to and finally resolved by binding arbitration as set out below, under the Arbitration Rules of the Dubai International Arbitration Center (DIAC), which rules (“Rules”) are deemed to be incorporated by reference into this clause. The number of arbitrators shall be one. The parties to the arbitration shall seek to agree on a sole arbitrator to be nominated to the DIAC court for appointment. If the parties to the arbitration fail to nominate a sole arbitrator within 30 days from the date of the service of the request upon the respondent (or such greater or lesser period as may be fixed by the DIAC Court), the sole arbitrator shall be appointed by the DIAC Court. The seat or legal place of the arbitration shall be Dubai International Arbitration Centre in Dubai, UAE.

The arbitration proceedings shall be conducted in the English language and the award shall be in English. The foregoing provisions of this clause are without prejudice to the right of eBariz.com to seek interim relief at any time from any court of competent jurisdiction (whether or not an arbitrator has been appointed) and eBariz.com shall not be deemed to have breached this arbitration agreement or infringed the powers of the arbitrator for having done so..

LIMITATIONS OF LIABILITY

In all circumstances eBariz.com‘s maximum liability is limited to the purchase price of the products sold. eBariz.com shall not, under any circumstances, be liable upon a claim or action in contract, tort, indemnity or contribution, or other claims relating to the products it sells which exceed this liability limit. eBariz.com shall not be liable for third-party claims for damages against the customer, or for malfunction, delays, interruption of service, loss of business, loss or damage to exemplary damages, whether or not eBariz.com has been made aware of the possibility of such claims or damages.

If you are dissatisfied with the Site or any content or materials on it, your sole exclusive remedy is to discontinue your use of it. Further, you agree that any unauthorized use of the Site and its services as a result of your negligent act or omission would result in irreparable injury to eBariz.com and eBariz shall treat any such unauthorized use as subject to the Terms and Conditions of this User Agreement.

Products deemed to be super-savers or highly discounted by the company might be limited by quantity per order and the company reserve the right to alter the ordered quantity for such products and or cancel the order with or without the consent of the customer.

eBariz.com reserves the right to cancel any unpaid order under any circumstances without any owed liability towards the customer or otherwise, in case of paid order Ebariz.com still reserves this right as long as paid amount is returned in full.

GOVERNING LAW

This User Agreement is governed by and construed in accordance with, UAE law. This clause will survive any expiry or cancellation of this User Agreement for any reason.

PreOrder 
Pre-order is a service that lets you order a product before the official launch date.

  • Delivery: We aim to deliver pre-ordered products on the official launch date, provided that we have received and processed your payment. This is not always possible due to availability at our warehouse. Delivery charges may apply to all pre-orders unless otherwise stated. Standard Delivery timelines will apply from the moment the pre-ordered product is available. We reserve the right to cancel any order for reasons that we may or may not disclose. The delivery date for the pre-ordered items may change without any prior notice or confirmation.
  • Payment: Payment must be made in advance to confirm you’re preorder. If for any reason you would like to cancel your order before shipment you must do so at least 3 days before we dispatch your order.

PRIVACY POLICY

By visiting the eBariz.com website or any other websites operated by eBariz.com or its affiliates (collectively, the ‘Site”), you agree to accept the practices described in this Privacy Notice. If you do not agree to the terms of this Privacy Notice, please do not use the Site. Each time you use the Site, you should check the date of this Privacy Notice (which appears above) and review any changes that have been made since your last visit to the Site. As with all shopping websites, we collect personal information from you.

LIMITATIONS ON LIABILITY

In no event will eBariz.com or its parent, affiliates, licensees, or any party involved in creating, producing, or delivering the site or its products or services be liable in any manner whatsoever for any incidental, consequential, indirect, special, or punitive damages arising out of your access, use or inability to use the site, or in connection with any failure or performance, error, omission, interruption, defect, delay in operation or transmission, computer virus or line or system failure (including loss of profits, loss of business or data, business interruption, and damages that result from inaccuracy of the information or inconvenience, delay, or loss of the use of the site). The foregoing limitations apply whether the alleged liability is based on contract, tort, negligence, strict liability, or any other basis, even if ebariz.Com or its affiliates or any other party has been advised of the possibility of such damages.

WARRANTY & RETURNS

All warranty periods indicated are from eBariz.com, unless otherwise noted, and are limited by the manufacturer’s warranty policies. Actual manufacturer warranty periods may vary depending on product and manufacturer and may be longer than the warranty period covered by Ebariz.com. Please refer to the manufacturer’s website or product manuals/packaging for more information.

Generally, the manufacturer’s limited warranty will only cover the product for manufacturing defects and will not cover any physical damage to the product from misuse, dropping, any damage, etc. In no way does eBariz.com warrant any product for fitness of use or for representations made by the manufacturer.

To receive warranty service on your product, you must contact eBariz.com by phone or email to address the problem. Our technical support team will be registering your complaint and provide you with an RMA number which will be used for further services.

After receiving an RMA number, you will be required to ship the defective item back to eBariz.com with the RMA number marked or labeled on the package. Also, include a copy of your invoice and any email correspondence you have had with our support staff. Ebariz.com recommends that appropriate measures are taken to safeguard the product from damage during shipping, as Ebariz.com does not warrant a physically damaged product. Ebariz.com does not accept packages sent collect or COD. The customer must pay for shipping and provide the necessary information and receipt for reimbursement, if applicable.

eBariz.com will not cover any shipping charges for any products.

If the customer will use for picking up and dropping our service for RMA items, he will be charged AED 50/- (Fifty Dirham) for our pickup and drop services.

If the product is determined to be defective and it is covered by our warranty policy, you will be informed and when it will be ready will be shipped out as soon as possible or you have to come to our store to pick up when it will be ready for pick up and you will be informed by e-mail or phone.

For any defective products you will have to wait an estimated 2~6 weeks until eBariz.com gets a replacement or repaired item back from the manufacturer or supplier.

It is recommended that customers deal directly with the manufacturer for all retail products for faster turnaround times. Some manufacturers offer direct-swap, cross-ship, or even next-day to-your-door replacement warranty services.

eBariz.com can help facilitate warranty service between you and the manufacturer for retail items, but will not cover any expenses incurred for warranty service. For any products that have a warranty, eBariz.com will not cover shipping charges.

If the product sent to us is not defective, you will be charged for shipping charges.

Refunds will be made through the original mode of payment selected at the time of order generation.

eBariz.com is limited to the service level offered by the manufacturer or supplier, please read your product warranty information carefully before contacting us.

CUSTOMER SATISFACTION (STANDARD RETURN POLICY)

PROMOTIONAL, DEALS, SALE, DISCOUNT, AND SELLING WITH SUPER LOW PRICE PRODUCTS STANDARD RETURN POLICY

This is our Standard Return Policy for Promotional, Deals, Sale, Discount, and Selling with Super Low Price Products. Items covered by this policy must be returned for replacement within 14 days of the invoice date. Will be applied Restocking Fee from 15%. No warranty of any kind would be available on any products that are provided as part of promotional deals, special offers, bundle offers, clearance stock, or noted as free or super low price.

CASES AND ACCESSORIES RETURN POLICY

This is our Standard Return and Warranty policy for eBariz.com. Items covered by this policy cannot be returned unless there is any problem with the product shipping or delivery. But in case of wrong information about faulty items customer will be charged AED 50/- for pick & drop services.

The following conditions are not acceptable for return, warranty and replacement.

  • Any physical damage
  • Cases and Covers that are missing the manufacturer label containing model number and part number
  • that are missing the manufacturer warranty label
  • Cases and Covers that were missing and other accessories from the original box
  • Returned without original invoice
  • Cases and Covers which is not satisfy manufacturer warranty policy
  • Cases and Covers which is not satisfy Customer Satisfaction policy

LAPTOPS, NETBOOKS AND DESKTOPS STANDARD RETURN POLICY

  • Return for refund within: 14 days
  • Return for replacement within: 14 days
  • Restocking Fee:  Yes
  • Warranty: 1 year

This is our Standard Return and Warranty policy for Laptops and Netbooks. Items covered by this policy can be returned within 14 days of the invoice date. Warranty pick & drop from customer location (only within UAE) will be free of charge within 7 days of the invoice date. But in case of wrong information about faulty items, customers will be charged AED 50/- for pick & drop service.

The following conditions are not acceptable for return, warranty and replacement.

  • Laptops and Netbooks which not satisfy manufacturer warranty policy
  • Laptops and Netbooks which are not satisfying Customer Satisfaction policy
  • Laptops and Netbooks models which are coming with original Windows or any other software, after using them, activating or starting software cannot be returned or replaced.

REFURBISHED OR RECERTIFIED LAPTOPS, NETBOOKS STANDARD RETURN POLICY

  • Return for refund within: 3 days
  • Return for replacement within: 3 days

  • Warranty: 3 month

This is our Standard Return and Warranty policy for Refurbished or Recertified Laptops and Netbooks. Items covered by this policy can be returned within 3 days of the invoice date. Warranty pick & drop from customer location (only within UAE) will be free of charge within 7 days of the invoice date. But in case wrong information about faulty items, the customer will be charged AED 50/- for pick & drop service.

The following conditions are not acceptable for return, warranty and replacement.

  • Any physical damage
  • Laptops and Netbooks that are missing the manufacturer label containing model number and part number
  • Laptops and Netbooks that are missing the manufacturer warranty label
  • Laptops and Netbooks that were missing parts, box, adapters, or any other accessories from the original box
  • Returned without original invoice
  • Laptops and Netbooks which not satisfy manufacturer warranty policy
  • Laptops and Netbooks which are not satisfying Customer Satisfaction policy
  • Laptops and Netbooks models which are coming with original Windows or any other software, after using them, activating or starting software cannot be returned or replaced.

MOBILE PHONES, SMARTPHONES STANDARD RETURN POLICY FOR WARRANTIED MODELS ONLY

  • Return for refund within: 7 days (must be unopened, brand new condition)
  • Return for replacement within: 7 days (must be unopened, brand new condition)
  • Restocking Fee:  Yes
  • Warranty: 1 year
  • Note: Mobile Phones or Smart Phones if we are selling with warranty, we will indicate about warranty period in the invoice. If in the invoice we did not indicate warranty this is meaning Mobile Phone or Smart Phone without warranty!

This is our Standard Return and Warranty policy for Warrantied Mobiles Phones, Smart Phones. Items covered by this policy can be returned within 7 days of the invoice date. Warranty pick & drop from customer location (only within UAE) will be free of charge within 7 days of the invoice date. But in case of wrong information about faulty items, the customer will be charged AED 50/- for pick & drop service.

The following conditions are not acceptable for return, warranty and replacement.

  • Any physical damage
  • In invoice not indicated warranty period
  • Mobiles Phones, Smart Phones that are missing the manufacturer label containing model number and part number

This is our Standard Return and Warranty policy for Warrantied Cameras. Items covered by this policy can be returned within 7 days of the invoice date. Warranty pick & drop from customer location (only within UAE) will be free of charge within 7 days of the invoice date. But in case of wrong information about faulty items, customers will be charged AED 50/- for pick & drop service.
